These Terms of Service (“Terms”) govern your use of the website ayvazcapital.com (the “Site”), operated by Ayvaz Capital Group Inc (“Ayvaz Capital Group,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

We are a California-licensed real estate broker providing business-purpose loans secured by non-owner-occupied investment property.
2. What This Site Is
The Site provides general information about our loan programs, allows you to submit a loan inquiry, and publishes educational content about real estate investing and financing.
The Site is a marketing and informational resource. It is not a loan application platform, a borrower portal, or a payment system. Submitting a form on the Site starts a conversation; it does not create a loan application, and no loan exists until documented and closed through our formal process.
3. Not an Offer of Credit
Nothing on this Site is an offer, commitment, or promise to lend.
Loan amounts, loan-to-value ratios, after-repair value figures, interest rates, terms, fees, closing timelines, and program descriptions shown on the Site are illustrative estimates only. They are examples of terms that may be available in some transactions. They are not quotes, and they are not available to every applicant or every property.
Actual terms depend on the specific property, the transaction structure, the borrower, our underwriting review, and market conditions at the time. All loans are subject to underwriting approval, property evaluation, and satisfactory documentation. We may decline any request for any lawful reason.
Rates and terms are subject to change without notice.
4. Business-Purpose Loans Only
We originate business-purpose loans secured by non-owner-occupied investment property. We do not make loans for personal, family, or household purposes, and we do not lend on primary residences. Any inquiry submitted through the Site is understood to concern a business-purpose transaction.
5. Information You Submit
When you submit information through the Site, you represent that it is accurate and that you have the authority to provide it. If you submit information about another person — a co-borrower, guarantor, business partner, or anyone else — you represent that you have their permission to do so.
Do not submit Social Security numbers, bank account numbers, or identification documents through the website forms or chat widget. We will provide a secure method for sensitive documents during the application process.

6. Communications
By submitting your contact information, you agree that we may contact you about your inquiry by phone and email. Text messaging requires separate, optional consent, which you may give by checking a consent box on our form and may withdraw at any time by replying STOP.
Consent to receive marketing communications is never required to apply for or receive a loan.
7. SMS Messaging Program
Program description. Ayvaz Capital Group Inc operates two SMS programs. Our transactional program sends messages related to a loan inquiry you have submitted, including acknowledgment of your inquiry, requests for documentation, appointment coordination, and status updates on your file. Our marketing program sends occasional messages about our loan programs and services. You may opt in to either, both, or neither.
How to opt in. Contacts opt in by submitting the loan inquiry form on our website and checking one or both SMS consent checkboxes. Both checkboxes are unchecked by default and optional. Consent to receive text messages is not a condition of applying for or receiving any loan or service from us.
Eligibility. You must be at least 18 years of age to opt in to receive text messages from us. By providing your mobile number and checking a consent box, you represent that you are 18 or older and that you are the subscriber or customary user of the number provided.
Message frequency. Message frequency varies based on your activity and the status of your loan inquiry.
Cost. Message and data rates may apply. Ayvaz Capital Group does not charge for text messages, but your mobile carrier’s standard messaging and data rates will apply. Contact your carrier for details about your plan.
Opting out. Reply STOP to any message to stop receiving texts from that program. You will receive a confirmation message and no further messages will be sent. Reply HELP for assistance, or contact us at (818) 445-2228 or petros@ayvazcapital.com.
Carrier liability. Mobile carriers are not liable for delayed or undelivered messages. We do not guarantee that messages will be delivered, and delivery depends on factors outside our control, including your carrier’s network and your device.
Supported carriers. Our messaging program is supported on major U.S. wireless carriers. Carrier participation may change without notice.
Changing your number. If you change or deactivate your mobile number, please notify us so that we do not send messages to a number that has been reassigned to someone else.
Privacy. Information collected in connection with our SMS program is handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
8. Educational Content
Blog posts, guides, downloadable materials, and other content on the Site are provided for general educational purposes. They are not legal, tax, accounting, financial, or investment advice, and they do not account for your specific circumstances.
Real estate investing involves risk, including the risk of losing your investment. Past results described in any content do not predict future outcomes. Consult your own attorney, accountant, and advisors before making decisions.
9. Downloadable Materials
Guides and other materials we make available for download are provided for your personal and internal business use. You may not republish, resell, or distribute them commercially without our written permission. Sharing them with colleagues or partners in the ordinary course of evaluating a transaction is fine.
10. Intellectual Property
The Site and its contents — including text, blog posts, graphics, logos, images, and design — are owned by Ayvaz Capital Group Inc or our licensors and are protected by copyright and trademark law.
You may view and print Site content for your personal or internal business use. You may quote brief excerpts of our blog content with attribution and a link back to the original. You may not copy, republish, or reproduce substantial portions of the Site, scrape or systematically extract content, or use our name, logo, or branding without our written permission.
11. Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose
- Submit false, misleading, or fraudulent information
- Submit inquiries on behalf of someone else without their authorization
- Attempt to gain unauthorized access to the Site, our systems, or other users’ information
- Introduce malware, viruses, or harmful code
- Use automated tools to scrape, harvest, or extract data from the Site
- Interfere with the operation of the Site or the servers hosting it
- Use the Site to send unsolicited commercial messages
12. Third-Party Links and Services
The Site may link to third-party websites and uses third-party services for analytics, advertising, messaging, and scheduling. We are not responsible for the content, accuracy, or practices of third parties. Links do not imply endorsement.
13. Disclaimer of Warranties
The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Site will be uninterrupted, error-free, or secure, or that content on the Site is accurate, complete, or current.
14. Limitation of Liability
To the fullest extent permitted by law, Ayvaz Capital Group Inc and its officers, directors, employees, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site, including lost profits, lost business opportunities, or lost data, even if we have been advised of the possibility of such damages.
Our total liability arising out of or related to your use of the Site will not exceed one hundred dollars ($100).
Nothing in these Terms limits liability that cannot be limited under applicable law.
15. Indemnification
You agree to indemnify and hold harmless Ayvaz Capital Group Inc from any claims, damages, losses, and reasonable attorneys’ fees arising out of your violation of these Terms, your misuse of the Site, or information you submit that is false or that you were not authorized to provide.
16. Relationship to Loan Documents
These Terms govern your use of the Site only. If you enter into a loan with us, that transaction is governed by the loan agreement, promissory note, deed of trust, and related documents you sign. Those documents control over these Terms with respect to the loan, and may contain their own dispute resolution provisions that differ from Section 17 below.
17. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles.
Any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Los Angeles County, California. You consent to the personal jurisdiction of those courts.
18. Changes to These Terms
We may update these Terms at any time. When we do, we will revise the “Last Updated” date above. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
19. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
