Ayvaz Capital Group Inc (“Ayvaz Capital Group,” “we,” “us,” or “our”) operates the website ayvazcapital.com (the “Site”) and provides business-purpose real estate loans secured by non-owner-occupied investment property. This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices you have.
By using the Site or submitting information to us, you agree to the practices described in this policy.

2. Information We Collect
Information You Provide Through the Site
When you submit a form, book a consultation, use our chat widget, call us, or email us, we may collect:
- Name
- Phone number
- Email address
- Property address and property details
- Loan program requested, loan amount, and whether you are purchasing or refinancing
- Any other information you choose to include in a message to us
Information Collected During a Loan Application
If you proceed with a loan application, we collect additional information necessary to evaluate, underwrite, and fund the loan. Depending on the transaction, this may include:
- Legal name, date of birth, and Social Security number or Individual Taxpayer Identification Number
- Government-issued identification
- Home address and contact information
- Citizenship status and primary occupation
- Credit history and credit score
- Bank statements, proof of liquid reserves, and source of funds for the down payment
- Existing mortgage statements and payoff information
- Entity formation documents, operating agreements, and EIN for borrowing entities
- Property information including purchase price, rehab or construction budget, after-repair value, occupancy status, and target closing date
- Prior real estate investment experience
- Insurance, title, escrow, and closing documentation
- Co-borrower or guarantor information, where applicable
Information Collected Automatically
When you visit the Site, certain information is collected automatically through cookies and similar technologies:
- IP address and approximate location
- Browser type, device type, and operating system
- Pages viewed, time spent, and referring website
- Advertising identifiers used for campaign measurement
We use the following third-party services on the Site, which may set their own cookies and collect information according to their own privacy policies: Google Analytics and Google Tag Manager, Meta (Facebook) Pixel, Klaviyo, CallRail, and LeadConnector (chat widget).
Call Information
When you call us, we collect your phone number, the date and time of the call, and call duration. We do not record calls.
3. Credit Reports and Consumer Reports
In connection with a loan application, and with your authorization, we may obtain a consumer report (credit report) about you from one or more consumer reporting agencies. We use this information solely to evaluate your application and the loan request. Our collection and use of consumer report information is governed by the federal Fair Credit Reporting Act (FCRA).
Whether we obtain a consumer report, and the type of report obtained, depends on the structure of the transaction and the parties involved. Where we decline an application based in whole or in part on information contained in a consumer report, and where notice is required by applicable law, we will provide the disclosures required, including identification of the consumer reporting agency that supplied the report. Requirements differ depending on whether the applicant is an individual or a business entity.
4. How We Use Your Information
We use the information we collect to:
- Respond to your loan inquiry and evaluate your request
- Underwrite, approve, document, close, and fund your loan
- Request documentation needed to complete your file
- Schedule and coordinate calls and appointments
- Provide status updates on your loan
- Service, manage, and administer your loan after closing
- Send you marketing communications about our loan programs, where you have consented to receive them
- Improve our Site, measure advertising performance, and understand how visitors use our services
- Detect and prevent fraud and protect the security of our systems
- Comply with legal, regulatory, and licensing obligations
5. SMS and Text Messaging
If you provide your phone number and separately check an SMS consent box on our form, you consent to receive text messages from Ayvaz Capital Group Inc. We operate two separate programs — transactional messages about your loan inquiry, and marketing messages about our loan programs. Each requires its own checkbox. Both are unchecked by default. SMS consent is optional and is never required to submit a form, to apply for a loan, or to receive any service from us.
You must be at least 18 years of age to opt in. Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out of further messages. Reply HELP for assistance, or contact us at (818) 445-2228.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.
Your mobile number and SMS consent record are used solely by Ayvaz Capital Group Inc to communicate with you. They are disclosed only to the messaging service providers that deliver our messages on our behalf, and only for that purpose. They are not sold, rented, or provided to lenders, loan purchasers, capital partners, brokers, marketers, or any other third party. This restriction applies regardless of any other sharing described elsewhere in this policy.
6. How We Share Information
We do not sell or rent your personal information.
Apart from your mobile number and SMS consent data, which are never shared as described in Section 5, we may share information in the following circumstances:
- Service providers. Vendors who perform services on our behalf, including our customer relationship management platform, loan origination software, document storage, email and messaging providers, analytics providers, and hosting providers. These vendors receive only the information needed to perform their function and are not permitted to use it for their own purposes.
- Loan participants. In connection with a loan you have applied for or that we have funded, we may share loan file information with parties necessary to originate, close, document, service, insure, sell, or transfer that loan. These parties may include title companies, escrow companies, insurance providers, appraisers and valuation providers, attorneys, loan servicers, capital partners, and actual or prospective purchasers of the loan or of an interest in the loan, along with their agents, successors, and assigns.
- Loan servicing. We use a third-party loan servicer to administer payments and manage loans after closing. Your loan information is provided to the servicer for that purpose. If your loan is sold or transferred, your information will be provided to the new holder and to any successor servicer.
- Consumer reporting agencies. We may report loan payment history and account information to credit bureaus where applicable, and we obtain consumer reports as described in Section 3.
- Legal and regulatory. Where required by law, subpoena, court order, or regulatory examination, or to comply with our obligations as a licensed California real estate broker, or to protect our rights, property, or safety, or to investigate suspected fraud.
- Business transfers. In connection with a merger, acquisition, financing, or sale of assets, subject to this policy.
7. Financial Privacy Laws
Certain information we collect in connection with lending activity is governed by financial privacy laws in addition to this policy. These may include the Fair Credit Reporting Act (FCRA), and, where applicable to the transaction, the Gramm-Leach-Bliley Act (GLBA) and the California Financial Information Privacy Act (FIPA). Where those laws apply, they govern our handling of the covered information, and certain rights described in this policy may be limited or superseded accordingly.
Most loans we originate are business-purpose loans secured by non-owner-occupied investment property and are not consumer credit transactions. The application of specific consumer financial privacy laws depends on the nature of the individual transaction.
8. Your Choices
- Text messages. Reply STOP to any message to stop receiving texts.
- Email. Click the unsubscribe link at the bottom of any marketing email.
- Cookies. Most browsers let you refuse or delete cookies. Some parts of the Site may not function properly if you do.
- Advertising. You can manage interest-based advertising preferences through the Digital Advertising Alliance and the Network Advertising Initiative opt-out tools.
Opting out of marketing communications does not stop transactional messages about a loan you have applied for or that we are servicing.
9. California Privacy Rights
If you are a California resident, you may have the right to:
- Know what personal information we have collected about you and how we use and share it
- Request deletion of your personal information, subject to legal and recordkeeping exceptions
- Request correction of inaccurate personal information
- Opt out of the sale or sharing of personal information — we do not sell or share personal information as those terms are defined under California law
- Not be discriminated against for exercising these rights

Information collected and maintained in connection with a loan application or a funded loan may be exempt from some of these rights under the financial privacy laws described in Section 7, and we are required to retain certain loan records regardless of a deletion request.
10. Data Retention
We retain personal information for as long as needed to provide our services, comply with legal and regulatory recordkeeping requirements applicable to real estate lending and California real estate broker licensing, resolve disputes, and enforce our agreements. Loan application and funded loan records are retained for the periods required by applicable law, which may extend for years after a loan is paid off.
11. Data Security
We use reasonable administrative, technical, and physical safeguards to protect the information we collect, including sensitive information such as Social Security numbers, identification documents, and financial statements. Our website uses SSL/TLS encryption to protect data transmitted between your browser and our servers. Sensitive documents are collected through a secure document portal rather than by email. Access to sensitive borrower information is restricted to personnel and service providers who need it to perform their role, and access is reviewed periodically. We maintain procedures to detect, respond to, and notify affected individuals of any data breach as required by California law.
No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please do not send Social Security numbers, bank account numbers, or identification documents through the website contact forms, the chat widget, or unencrypted email. We will provide a secure method for submitting sensitive documents during the application process.
12. Children’s Privacy
The Site is not directed to individuals under 18, and we do not knowingly collect personal information from anyone under 18. You must be at least 18 years of age to submit information to us or to opt in to receive text messages. If you believe a minor has provided us information, contact us and we will delete it.
13. Third-Party Links
The Site may link to third-party websites. We are not responsible for the privacy practices of those sites, and we encourage you to review their privacy policies.
14. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last Updated” date above. Material changes will be posted on this page.
